Another zed bites the dust :( [update -replacement zed pics pg3]

I don't really know why I'm posting this here...just trying to make sense of a crappy situation I found myself in and 'share it with the class' so to speak.

 

Unfortunately on Monday I wrote off my beloved 300ZX :( on the M6 :(

 

I was in the middle lane in a 50 zone. Arctics on the inside and flow of traffic on the outside. The motorway was on a slope so good view of the traffic in front. In starts to bunch up in the distance so I take my foot off the gas. The car in front brake flights come on so I start to brake progressively but then I realise it had done an emergency stop so plant my brakes on. This wasn't good enough so I ploughed into the back of her.

 

There was no apparent reason for the other car stopping. If there'd been a collision or something then I would have slammed the brakes on full but there was nothing. It was lucky I didn't swerve as I'd be under a lorry.

 

The lady driver of the car in front has actually admitted full responsibility. It sounds like her automatic got knocked into 'park' somehow and she panicked. Despite this admission her insurers say it's my fault.

 

I've been torturing myself going over and over in my mind about this. Had it been an apparent emergency I am 100% confident I would have stopped in time as I do leave a very good gap in traffic but you can't go planting the brakes on full every time you see a car's brake lights come on.

 

Thankfully no one was hurt and both cars managed to get onto the hard shoulder. No one else stopped to be witnesses. Highways Agency got called out but as there was no damage to the central reservation etc there was nothing for them to do.

 

So that's another Zed gone. Sorry guys! :(

Really sorry to hear this, but the main thing is your fine and no one was hurt. Typical insurance companies.

 

Are you getting a payout or are you 3rd party only? If your getting a payout then hopefully you can get another one

So sorry to hear this Sarah. But THE most important thing is you're OK. And by the sounds of it, it was beyond your control and if you'd of panicked in the same way, the could of easily been many more than 2 cars involved.

I'm 99% confident that if there'd been an obvious cause of her coming to a stop I'd have avoided it as the brake pedal would have been flat down as soon as I saw a hazard come up...but she did this emergency stop out of a clear blue sky hence I started to brake normally when I saw her brake lights come on. Although the driver has said to her insurer that she was fully at fault they're saying I didn't leave enough room for braking. My insurers are saying hey will try and fight my case due to 'extenuating circumstances' but I'm not holding out much hope.

 

To add another bizarre twist to this tale is that the driver is a stuntwoman who was enroute to a job where she was going to fall down a flight of stairs. She managed to arrange for a courtesy car to take her to the gig so if she puts in for whippy I'd be a bit miffed!

 

I've still got my beloved 350 so not totally zed-less and will be back in a 300 again soon...I'd been itching to get a twin tubo version anyway ;)

Man that's such terrible luck, Get a statement from the woman to say her car developed a problem

 

causing the automatic transmission to lock up, then take it to a solicitor who specialises in accidents

 

on a no win no fee basis..! Then take it from there.

 

Buy back the salvage and re-build you pride and joy.. Good Luck mate. :thumbs:

Sad to hear this but glad both parties are both ok. I am afraid as you drove into the car in front their insurance will claim from you unless the other driver informs her insurance she was totally to blame due to performing an emergency stop for no real reason, which I can't really see happening. At least your insured and It will get taken care of anyway :thumbs:

It`s never nice being involved in an accident whether at fault or not as I`m sure most of us will know and feel gutted for you.

Not wanting to stick the boot in to your already miserable situation but I think you`ll struggle to avoid the blame and will be setting yourself up for a lot of grief and mither if you want to fight it. It will always come down to the fact that for whatever reason the car in front of you stopped and you couldn`t which will always suggest you were either too close, going too fast or not paying attention to the road/traffic conditions. Even if the car in front does something totally unexpected the rules of good driving dictate that you should always be in a position to be able to stop no matter what. At best if she maintains her honesty about it she might be apportioned a part of the blame as well but how likely is it she`s going to do that once her insurance and solicitors get involved and her story then changes to she had to brake suddenly for whatever and you just ran into the back of her. Maybe just me being cynical but I`ve seen lots of it and especially if there are no other witnesses, if it was me, I would just leave it to the insurance company to sort out, that`s what we pay it for after all.
