With regard to getting insurance as a limited company the underwriter will almost certainly only offer cover as long as the products being sold by the business meet British Standard XXXX etc. They simply wont offer blanket insurance for a company to sell whatever they like and foot the risk. Again this is where discussions with another expert, this time in the field of business insurance would be good. Design and manufactre of a product is only part of the process, as is apparent from these discussions, the attainment of any necessary certifications and insurances and meting of any specific standards is just as much if not more work.

True, but the selling of a semi permanent part of an engine as show use only may also get caught up in selling items not fit for purpose. Hence the strong advice to seek professional legal opinions, as it is certainly a minefield.
-
Im not a legal expert by any means. Although the "for show use only" may remove some liability, it would be a bit of a minefield as you would have to prove that the purhaser knew this at the time of purchase, and also that the fault didnt occur whilst parked up revving the car at a show. Also, it would be very difficult to justify an integral part as a show use only product. I would seek professional legal advice before launching a carbon part which is anything above cosmetic tbh. Carbon cover for a range of existing plenums may have a lot more legs in it.

Not strictly true. The sale of goods act is between the seller and the purchaser. Meaning that even as just a "distributor" any issues arrising from the sale of the product are firstly taken up with the seller. Just as I have an issue with the new car I bought and the manufacturer couldn't care less (even though the fault has occured during the manufacturing process), I am being directed to take the matter up with the dealer (seller).

Scott, although you may not find any direct statements of insurance/guarantee relating to the faulty plenum causing damage, and they just mention guarantees of failure of the plenum iteslf, the product would still be covered under the sale of goods act. If the product is not fit for purpose and fails then the seller would be liable not only for the cost of the product, but if damage to any other component is directly attributable to the faulty product, they would also be liable for repairs to the other components. This is why the R&D is a highly important process. Although it may seem like some have put a dampener on this product, I feel they could be sving you from a VERY expensive legal minefield. Though if you do press ahead with the product, I can only suggest that you consult with an appropriate legal representative who should be able to inform you of all the necessary insurances you will need. It may also be the case that as the part is integral to the safe function of a motor vehicle that there are certain standards and tests which have to be passed in order to legally sell the product. This is certainly the case with tyre manufacturers, brake pad manufacturers and wheel manufacturers etc.. So could be worth some more investigation before placing this on any road going vehicle. The above is meant to be constructive, so please dont construe this a poo pooing your idea.

A trader is responsible for their own public liability insurances, guarantees and warantees. A public forum cannot insure against products sold by third parties to third parties. I would also be very interested to see on what grounds a member could take action against the club if a product they purchased from a third party failed to meet standards expected. This club does not endorse any products, and does not directly sell products other than the club stickers. If you anyone does wish to take issue with the club due to damage caused by a faulty vinyl sticker, they can contact any one of the team. Of course on other forums where members of the team actively promote a single trader or products thereof, there may be an inference of related trading/advertising and as such can see why insurance may be required. If the club does actively sell or allow its name to be used in the endorsement of any product we shall ensure the required insurances are in place, at present however we provide no such endorsement or gaurantee for any product sold by any supplier, we are simply an advertising medium. We control "who" can trade on this forum, but our allowance of trading can not be seen as vouching for any particular trader. Just as Autotrader could not vouch for any of the numerous car garages advertising on the website. Though again, the level of such indemnity is questionable. As an example - Persil is advertised with the strapline "the only washing powder reccomended by Hotpoint". Exactly how interested (or indeed legaly liable) do you think Hotpoint would be if I had a faulty box of Persil?

My prestige editions are on their way too - I doubt the Night Vision goggles will be up to much for the price, but Im just a big kid. Though if they do work reasonably well, I have today found that there are couple of rats nests in and around my garden and a couple of the sheds, so I shall be getting my rifle back from my dads and spending an eveningor two scouting my garden out shooting the pesky little buggers

I had an experience of this with the Altea, but didnt escape.. What made it worse was that it was one of those, nice and light trolleys they have at Wickes. Just put my bag of items and tin of paint in the boot, get in the car to set off and there is a land rover in front of me, so I wait until he drives off, and just as he does so he reveals a trolley flying down the car park - no time to stop it, and 1 second later it slammed into the front end. Luckily the bumper took most of the hit, but the headlight got a few grazes too. Just after I had got the car back from having a few scratches sorted ready for selling! I swear if I had seen who had left the trolley loose, and they were still in the car park, I would have pushed the trolley over to their car and attempted to fit it like some retro Halfords mod to one of their doors.

Thanks a million guys, I'll get a photo of him with his pink shoes. It's really made his day, brilliant! -
Is your car lowered? I've had a problem with mine scraping, and its taken a couple of knocks on Wales/Scotland drives, but its never cracked, only ever scuffed under the corners near the wheel arches (lowest point). Has it cracked in the same place as a previous break? Perhaps this is the reason for it going again and the whole thing is weakened now? As above, perhaps a thin steel brace mounted on the inside of the lip may help, but having that made and fitted may outweigh a few simple repairs each time?

As per the title, Nissan in Howden are offering a great discount for our members in conjunction with their 370Z test drive Next Sunday (8th November). After youve treated the kids to sparklers and fireworks on Saturday night, why not treat yourself to a Sunday looking at Nissans latest offering, trying the car out for yourself and meeting with other members. Heres the thread: viewtopic.php?f=87&t=29080&start=0

Hi, I know its cheeky, but I thought I would try and use the power of this forum to help one of my friends out. He is a chap that I used to live across the road from, who is quite into his cycling, running etc... So much so that he has undertaken cycles across France, and the UK all in the name of charity, and has raised over £40 grand for varous charities over time. I cant jog or cycle round my new garden without getting out of puff, so I take my hat off to him for undertaking such feats in the name of charity. He is now listed as one of the final four contestants in a competition to win some signed cycling shoes (may sound geeky, but to him it means a great deal). If you have access to facebook, you can help my friend Neil win this prize, and I personally think it would be a great reward for his efforts over the years. So - if you would like to help out, and you have access to facebook simply do the following: 1. On facebook search for 'Wiggle' - you should find an orange looking logo with the word wiggle written on it. 2. Once on the 'Wiggle' page click on 'become a fan' 3. Then scroll down to the comment that states "entrant no3 - Neil Armitage", then just click on "like" next to this comment. Thats all there is to it!! The winner is the person with the most 'likes' by Friday noon. So if you can do it sooner rather than later it would be much appreciated. Many thanks in advance, it means a lot.

Well, if its a true pirate copy it will be done on double layer blanks so as to preserve the original without any compression or stripping - but this is getting into a very grey area.... -
£15k for a roof? Are the people in charge of pricing Nissan spares smoking something in category B? You may as well pick up a whole roadster for the £15k and have a spare for every part on the car!

I've seen plenty of pirate films of very poor quality that would disagree with this.........I've ruined many a good film cos I was too eager to see it, watched a dodgy copy and totally ruined it for myself I think what Chris means if you are coping a dvd from an original to another dvd, or a game for example (game consoles). Most pirate films are filmed by some numpty in a cinema with someone's head bobbing up and down infront of the camera then copied onto a dvd in a compressed format which will be of a much lower quality. That is correct - by "being in a rush to see it", then I guess you mean watching a film at home that is not out on DVD yet - then in that case, yes, you almost certainly will be watching one made in the fashion Dave describes above - a camcorder in a cinema job. What I refer to above as pirate media is copies made from the original DVD/CD. -

I think when we start to go down the route of comparing copies of bodykits to copied films/media its stretching things a bit too far. Although I dont condone pirate movies/music, a copy of digital media is no different to the original, whereas copies of physical items can vary wildly from the original. Although I do confess to partly being a brand snob, there are some items where even I know to draw the line. One example that springs to mind is "Monster Cables" and specifically their HDMI leads with gold connectors, silver coated conductors etc etc.... Retails at anything up to £60 for a 1m cable. Its no better than a normal 1m cable costing less than a fiver - it transmits a digital signal, so it either works or it doesnt. It simply can't work "better" than any other cable that works. Its just preying on the folk who used to buy gold plated phono plugs, zero oxygen copper cables etc (which ironically actually may make a difference). On longer runs of cable, then yes quality may become an issue as you will get sparklies with lower quality higher length runs. But for 1m cables, people are just wasting their money. -

Original doesnt necesarily mean better quality/fitment etc though. I recently bought a nice brand new "original" £40,000 Jag. The paint is @*!#, and the attitude Ive had from the dealer and Jaguar is also, @*!#. For me, a purchase is not just about the quality of the product, but also the quality of the seller and how well they deal with any problems that may arise. Whether they arise with original items, replicas or bespoke products. I have no issue with people seling replicas, as long as they are advertised as replicas, and the buyer knows they are purchasing a replica product. People who want to buy original items can source original items and make the choice to stay away from replicas. I have original GReddy parts on mine, I also have a bespoke rear from Speedracing, and I would not pay daft prices for Nismo B Pillar covers if I wanted carbon, I'd happily rock fakes. As long as the traders provide good service to members, advertise their goods accurately and truthfully, then I dont see what more can be done. -
If you can get yourself to the national home building show or something similar then you may be able to pick up a bargain from Samsung themselves. I was at the Grand Designs show a couple of weeks ago and the Samsung stand was selling these 46" series 7 displays at under a grand I didnt find out until I got home how much they were retail. I just assumed that as per usual all this "show special" pricing was the normal boll*cks and that a cheaper price would be found on the net. I was very much wrong.

I wonder what it would cost to set sonething like this up - Id happily loan at half their rates The worry is not getting paid back at all and having to send a couple of Zedrushs mates round to take their telly.

Also, having seen Marks, you need to extend every wire that goes to the door pod so this will take a little time.
