Hello, GT4, bad dealer and pain!

HI all, Iv been after a 350z for a long time , I finally bought one a 5 weeks back (gt4) with all nismo kit on it. a week after purchase i noticed it was on the middle of the dip stick oil wise so topped it up. did 250 Miles checked it a week later and it was down 8mm on the stick. first thing i did was go and change the PCV as i had some oil in the plenum. i advised the dealer of this 1st choice cars. topped the oil back up and did another 100 mils or so in one day and check it out agin .. the level had gone down :( did some research and found out about the up rev engine having oil issues, I contacted the dealer who said they needed to to inspect it, i said they need to collect it because of the oil issue i dont want to do any damage driving it to them and they are a 6 hour round trip by car and they haven't got a hire car so would need to take a 6 hour train ride home that again isnt very local to them, this was over 2 weeks ago and they keep coming up with excuses ect so i said about taking it to Abbey motor sport ,who are the local specialist and are members of the site the dealers wasn't interested in paying for them to take a look. so i agreed id pay for them to take a look.

they didn't find any substantial leaks other then 1 of the spark plug tube seals leaking on the rocker and noted that the engine has a strange note (suspect its still got the original spark plugs and was noted not to be in great condition) with the oil use im claiming they susspect its the piston oil ring issue well known with these rev up engines.

the dealer says nothing is wrong with the car despite not testing the oil consumption them selfs so the issue has been openend with the credit card company and trading standards. the issue is proving it has an issue other then saying it uses x amount of oil over y amount of miles .Iv sent the nissan TSB to every one involved that simply states 2 scenarios 1, oil use and 2 strang engine noises. both exists although 1 might just be a need for a new set of plugs.

But the plot thickens it turns out the dealer is well known on S2KI and piston heads for selling honda s2000s and some 350's with some real horror storys and being shut down at one point so i dont have much hope with the dealer fixing the issue as they havent even managed to collect the car, countless times they have called me a liar this got me a bit hot under the collar so i exposed that i had found out about him and his dodgy dealings. Naturally thats upset him and hasnt done me any favours with getting it sorted but i honestly now think that the end result would be the same.

 

any way HI to every one and i hope to get my Z sorted one way or another.. even if i have to pay 5k for a rebuild.

First off, hi and sorry to hear about your issues.

 

 

Some practical notes:

 

It's not the dealer's fault you live so far away. Any costs to get the car back to them is your burden, customer service notwithstanding.

How many miles have you done, and how much oil has been used? Up to 1L/1000mi is acceptable according to the tech documents.

You either need proof the car is faulty (so pay Abbey to strip down, not something I'd do) or you need to give the car back to them and reject it. Proof of oil usage would be acceptable to use in court, so receipts & videoing works.

You do need to give the car back to them one way or another, so take the easy approach first.

i did speak with trading standards and they did say it was reasonable to expect them to colelct it and they have said they will but things keep happenning like the clutch on the truck went now it has a flat wheel ... so on and so on.

iv done 1000 miles and its had 4.2L of oil. no smoke , abbey explained the cats are really good it hiding that.

indeed i dont want to pay to strip it down when it cost me 9.4K Iv tried rejecting it ( i did px my old car) so just taking it and leaving it is an issue.

I have monitored the usage in excel i now have left it on my drive with no fuel waiting for them to pick it up or the CC to do something about it under section 75 of consumer goods act because its not durable amongst a bunch of other things trading standards said from my description.,

Is it reasonable at this stage to ask from whom your purchased it from?

I still don't see that it's down to them to collect though. If you bought a toaster from Tesco in store you wouldn't expect them to come and collect it. Chuck enough fuel & oil in to make the trip, then leave it with them.

 

Basicaly Trading standards said that because im rejecting it and not local, i could do more damage and then it would be reasonable for me to correct the damage, so they should collect it. I offered to uship it to them for £100 and they just kept saying they will collect it.

I disagree. There's no proof it's broken from their POV (although it clearly is), and if it's not who is going to pay for that transport?

 

Put it this way, the longer it's at yours the more chance there is that they can say you broke it. If it's on their drive way, it's their problem. If you have it IN WRITING that they say they'll collect then grand, but if not I'd just get it trailered up there.

ye i know i need them to see it for them selfs and have stated that , all in writing, also have in writing they will collect il give them till the end of the week and at the same time im going to send a letter recorded delivery stating i give them 14 days to inspect and repair or should i not do that?

I presume you have heard all about them then? so you know the pain im about to entail

From what I remember they sell more nails than Screwfix.

 

They had a reputation for being complete broncos on here for years but not heard a squeak from them for a while.

 

Similar to Junction 17.......you'll hear of people buying decent cars from them but it seems to be by fluke rather than design.

 

Honestly I reckon you need to listen to Ekona (he's a right complaining git so he knows what he's on about :lol: )because you could be in for a hard slog of it.

I just figure that if/when it goes to court that if you've done over and above what's reasonable, then the court is highly likely to look more in your favour. It's a pain, and it's wrong, but it's also easier long term.

 

Send them a letter by SPECIAL delivery (not recorded, you want proof they signed for it) that you are rejecting the vehicle under the CRA 2015, and give them 14 days to give you a refund. In the mean time, send the car back to them. They have precisely nothing to stop them issuing the refund then.

250 quid for a low loader to dump it will be worth the wasted life you'll have trying to be reasonable with them......actually returning the car at your own cost really speaking is being more reasonable!

ok I will do that, because i have had the car just over 30 days now it shouldnt be an issue because in emails sent (according to trading standards that is enough proof to say that i do decline it) I will re literate it in a letter.

I am happy to keep the car if it was repaired but the reputation of the sales man is not good.

i am half inclined to just drop the lump out remove the rods and pistons and give to abbey to professionally say they are dead, then get them to rebuild it.

i can do it my self but really dont see why i should it wasnt a £1000 car other wise id just sort it my self.

Sorry to hear such a terrible story. Doesn't help you now but I would always do background checks on any dealer before buying a car from them. This should be a timely reminder to anyone buying a car.Hope you get it sorted. Try and pop along and say Hello at Incarnation in Brighton in April.

I just had an email from them to say the truck should be repaired on Wednesday and will contact about the collection when it is, they will need the car for a week to do tests.

Iv on purposely left the tank empty... just the way they gave it to me. also I am getting multiple engine miss fires (p300) coming up occasional. this happened literly as i bought the car and went to drive away they said it was because of the low fuel level and running the crap from the bottom of the tank and to put some fuel in and injector cleaner so i did and it did clear up but has come back

Mate do everything you can to have that car rejected.

 

The chances of S2k4u and Tonto doing a pucker repair are zilch if it needs a rebuild and from the sounds of it you've got a very sickly engine

Mate do everything you can to have that car rejected.

im trying , although they have there law team dealing with me (law data) ? i dont have the funds to get some one in the know to help me out so im relying on the internet to help me fight my case give advise.
